Terms of Service

1. Who these terms are with

These terms form an agreement between you and Dimitrije Pavlovic, trading as Pavlovic Media, Fischerweg 4, 4222 Zwingen, Switzerland(“we”, “us”), covering your use of PropertyClips AI at www.propertyclipsai.com and the applications we provide.

By creating an account you accept these terms. If you are using the service on behalf of a brokerage or team, you confirm you are authorised to accept them for that organisation.

2. The service

PropertyClips AI turns photographs you upload into short marketing videos. Our AI generates a staged or enhanced version of each photo, animates the transformation, and assembles the result into a video with music, text overlays and your branding.

The service is provided to you for business use. You need an account and an active paid plan to generate videos.

3. Plans, reels and credits

• A reel is one finished video, built from up to six photos. Each plan includes a set number of reels per month.
• Internally each photo in a reel consumes one scene credit. Credits are deducted when you start generating, not when you upload.
• Rollover - unused reels carry over into the following month, up to a maximum of double your monthly allowance. Anything above that cap expires.
• Extra reels - if you need more than your plan includes, you can buy additional reels at the price shown on the pricing page, or upgrade at any time.
• Plan features - available formats, video styles, AI voiceover, seats and brand kit - are as described on the pricing page and are enforced by the product.

If a generation fails for a technical reason on our side, the credits for that reel are returned to your balance.

4. Payment, cancellation and refunds

• Subscriptions are billed in advance, monthly or annually, through Stripe. Prices are shown on the pricing page and exclude any taxes that may apply in your country.
• Cancel anytime. Your plan stays active until the end of the period you have already paid for, and does not renew after that.
• Pause instead. For $9 per month you can pause your plan: generation is disabled, but your branding presets and unused reels are preserved.
• Refunds. Within 14 days of first starting a subscription, we will refund the value of any unused reels on request. Reels you have already generated are not refundable, because the AI processing costs are incurred at that moment.
• We may change prices with at least 30 days’ notice before your next renewal. If you do not accept the new price you can cancel before it takes effect.

5. Your content and your rights

• You keep ownership of the photos you upload and of the videos we generate for you. We claim no ownership over either.
• You grant us a limited licence to store and process your photos solely to provide the service - generating your videos, and showing them back to you in your library.
• We will not use your photos or finished videos in our own marketing without asking you first.
• You are free to use the videos we produce commercially, including on the MLS and on social platforms, subject to section 6.

You are responsible for your uploads. By uploading a photo you confirm you own it or have permission to use it, and that using it here does not breach anyone else’s rights - including your photographer’s licence, your brokerage’s rules, or the property owner’s wishes.

6. AI-staged imagery and MLS disclosure

This is the most important section for your compliance, so please read it.

• Videos produced by PropertyClips AI show digitally altered imagery. Rooms may appear furnished, repainted or renovated in ways that do not reflect the property’s actual condition.
• Every video includes a burned-in “virtually staged” disclosure overlay. This cannot be disabled.
• You remain responsible for complying with the advertising rules of your MLS, local association, state real-estate commission and brokerage. Requirements differ by jurisdiction, and some require additional or specific wording.
• You must not present AI-staged imagery as an accurate depiction of a property’s current condition, or remove, obscure or crop out the disclosure overlay.

We provide the disclosure overlay as a compliance aid. It does not constitute legal advice, and it does not guarantee compliance with the specific rules that apply to you.

7. Acceptable use

You agree not to:

• upload photos you do not have the right to use;
• upload content that is unlawful, defamatory, pornographic, hateful, or that depicts identifiable people without their consent;
• use the service to create misleading advertising, or to misrepresent a property in a way that could deceive a buyer;
• attempt to bypass plan limits, rate limits or billing, or share one account across people who should hold their own seats;
• reverse engineer, scrape or resell the service, or use it to build a competing product.

We may suspend or terminate accounts that breach these rules. Where a breach is serious - for example unlawful content - we may act without notice.

8. Availability and AI output

We work to keep the service available and reliable, but we do not guarantee uninterrupted access. We may change, suspend or discontinue features, and will give reasonable notice of significant changes.

AI output is inherently variable. Results depend heavily on the quality of the photos you provide, and generated imagery may contain artefacts or inaccuracies. You are responsible for reviewing every video before you publish it. Each reel includes one free scene regeneration if you are not happy with a scene.

9. Liability

The service is provided “as is”. To the extent permitted by law, we exclude implied warranties, and we are not liable for indirect or consequential loss, lost profits, lost business or lost data.

Our total liability arising out of or in connection with these terms is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Nothing in these terms excludes liability that cannot be excluded under Swiss law, including liability for death or personal injury caused by negligence, or for fraud.

10. Termination

You can close your account at any time from your settings. We may terminate or suspend your account if you materially breach these terms, or if we stop offering the service - in which case we will refund any unused portion of a prepaid period.

When your account is deleted, your photos and videos are deleted as described in our Privacy Policy. Download anything you want to keep before closing your account.

11. Changes to these terms

We may update these terms. If a change materially affects your rights we will give you at least 30 days’ notice by email or in the app. Continuing to use the service after that means you accept the updated terms.

12. Governing law

These terms are governed by the laws of Switzerland, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. Disputes will be subject to the exclusive jurisdiction of the courts of Basel-Landschaft, Switzerland, unless mandatory consumer-protection law in your country of residence gives you the right to bring a claim elsewhere.
